These terms and conditions apply to the use of this website, including use of all HerbDrugNutrient™ functionality offered on this website.  In using this website, you agree to be bound by these terms and conditions.  If you do not accept these terms and conditions, you must refrain from using the website.  These terms and conditions must be read in conjunction with any other applicable policies governing the use of this website. 2. Terminology

In these terms and conditions, the expression “we” and “our” are a reference to the Association of Naturopathic Practitioners (“ANP”) in the United Kingdom.

3. ACCESS TO THE WEBSITE

3.1           In order to be able to access the information offered on this website, you can either do so by first becoming a member (“ANP Member”) or by paying an annual subscription fee of £120 and accessing the website as a non-member (“Non-Member”) Access to the website is free of charge for ANP Members.

3.2           To become an ANP Member, you must complete your registration details, by way of completion of the online registration form, accessible here. As part of the registration process, you will be asked to provide details of your name and address, the name of your business, business address, business phone number, occupation, practitioner ID and the name of the association you are registered with.

3.3           To become a Non-Member, you will need to email us to request to become a Non-Member, following which we will provide you with access (on receipt of payment for subscription).

3.4           To become an ANP Member you must be one of the following:

3.4.1       a health practitioner; or

3.4.2       a researcher, academic or student.

3.5           We reserve the right to terminate your subscription at any time if you breach any of these terms and conditions.  If we terminate your subscription we may keep any subscription fees received prior to the date of termination.

3.6           You agree to ensure that your registration details are true and accurate at all times, including credit card details, if you supply them to buy premium content, goods or services through the website.  Specifically, you must notify us of any change to the registration details as originally supplied.

3.7           Upon registration, you will be provided with a password and log‑in. You must keep the password provided to you secure and confidential and you will need to change the password regularly, as prompted. You must not disclose your password or log‑in to anyone or give access to any part of this website which requires a password to anyone. If we become aware at any time that a password has been provided to an individual who is not a subscriber, we will arrange for the password to be disabled.

4               Limits of this website

4.1           Knowledge and practice in the fields of complementary medicine and pharmacology are changing constantly.  As new research and clinical experiences become available, changes in our treatment and drug therapy recommendations may become necessary, appropriate and/or preferable.  However, standard safety precautions must always be followed.  Subscribers are responsible for:

4.1.1       checking the most current product information provided by the manufacturer of the herb, supplement or drug to be prescribed;

4.1.2       verifying the recommended dose, method and duration of administration, and contraindications; and

4.1.3       determining dosages and the best treatment for each patient, and practising appropriate safety precautions, by relying on their experience and knowledge of the patient.

4.2           Communication between practitioners is encouraged, to ensure patient safety and the best possible clinical outcome.

4.3           Subscribers are advised that any information on HerbDrugNutrient™ supplied by sponsors or manufacturers of medicines about their products is supplied as is by them and no responsibility is taken for the accuracy of the information or for the efficacy of any therapeutic claims they make.  Subscribers are also advised that no responsibility is taken for the accuracy of information or any stated or implied therapeutic or other benefit concerning goods and services that may from time to time be for sale or supplied free on the website.

4.4           We use reasonable endeavours to ensure that the information contained within this website is as accurate and up to date as possible.  We retain the right to update the information on this website at any time.  The information in this HerbDrugNutrient™ website is intended as a practical guide to the safe and effective prescription of herbs and supplements in relation to their interactions with drugs in clinical practice.    It is not intended as a substitute for professional advice and guidance provided by a qualified health practitioner, or as a manual for self‑treatment.  You should seek professional advice for any specific medical conditions or, if you are a health practitioner, you should rely on your own training, education and experience and the standards of your profession.

5. LIABILITY

5.1           Our total aggregate liability under or in connection with these terms in relation to each ANP Member for any loss for any reason (including negligence) shall, in relation to any event and all events preceding that event (taken together), be limited to the total amount equal to the annual subscription fees paid by you (if applicable) or £120 if no subscription fee is payable.  Nothing in this clause 5.1 will limit or exclude our liability for death or personal injury caused by our negligence.

5.2           To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is hereby excluded.   In the event of a breach of the terms of this agreement:

5.2.1       the supplying of the services again; or

5.2.2       the payment of the cost of having the services supplied again.

6. Specific warnings

6.1           You are responsible for obtaining and operating all of the equipment, software and network connections and services necessary to access and use this website. We have no liability in respect of any failure or incompatibility in any user equipment, software or network connections.

6.2           You must take your own precautions to ensure that the process which you employ for accessing this website does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system.  You should also back‑up any data on a daily basis.  We do not accept responsibility for any interference or damage to your own computer system which arises in connection with your use of this website, or any linked website.

6.3           Whilst we have no reason to believe that any information contained on this website is inaccurate, we do not warrant the accuracy, adequacy or completeness of such information, nor do we undertake to keep this HerbDrugNutrient™ website updated.  We do not accept responsibility for loss suffered as a result of reliance by you upon the accuracy or currency of information contained on this HerbDrugNutrient™ website.

without our written permission or, in the case of third party material, from the owner of the intellectual property of  such third party material.

7.3           Except where otherwise specified, any word or device to which is attached the ™ or ® symbol is a trade mark.

7.4           If you use any of our trade marks in reference to our activities, products or services, you must include a statement attributing that trade mark to us.  You must not use any of our trademarks:

11. Termination of access

Access to this website may be terminated at any time by us without notice.  Clause 5 shall continue in full force and effect after the termination of this agreement.

12. Governing law

12.1         This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.

12.2         Subject to clause 13, each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.

13. Dispute resolution

13.1         If a party considers there is a dispute relating to this HerbDrugNutrient™ website, its functionality, or these terms and conditions (‘dispute’) it shall give the other party written notice of the dispute.  If the parties have not resolved the dispute within 30 days of the notice being given, the party who gave the notice shall initiate mediation according to the applicable laws and/or treaties.  If the dispute is not resolved in 60 days after mediation is initiated, mediation will terminate unless the parties otherwise agree.

13.2         A party must not commence legal proceedings against the other party in relation to a dispute until the procedure set out in the previous paragraph has been complied with, unless the relief sought by the party includes the grant of urgent interlocutory relief.

14. General

14.1         We accept no liability for any failure to comply with these terms and conditions where such failure is due to circumstances beyond our reasonable control.

14.2         If we waive any rights available to us under these terms and conditions on one occasion, this does not mean that those rights will automatically be waived on any other occasion.

14.3         If any of these terms and conditions is held to be invalid, unenforceable or illegal in a jurisdiction for any reason, the remaining terms and conditions shall nevertheless continue in full force in that jurisdiction.
